REQUEST SERVICES

Civil Enforcement

Acting on judgments and orders, within the authority the law allows.

From Judgment to Result

A judgment or order is only useful if it can be acted on. Fivestar Bailiff supports creditors, lawyers and businesses with the practical, field-level work involved in enforcing judgments and orders, as permitted by law. Some enforcement steps in Nova Scotia can only be carried out by the sheriff or under court direction. Where that applies, we help prepare and support the process rather than act in place of it.

How We Support Enforcement

File review

Confirming the order, the parties and the authority available before any field work begins.

Locating and attending

Confirming addresses, assets and circumstances relevant to enforcement.

Seizure where authorized

Seizing property only where the order, agreement or legislation authorizes it, and only within that authority.

Inventory and condition records

Itemized lists and photographs of any property involved.

Notices

Service of the notices required as part of the enforcement process.

Documentation

A complete written record of every attendance, conversation and action taken.

Working With Legal Counsel

Many enforcement files are directed by a lawyer. We take instructions from counsel, report back in a format suited to the file and provide records that can support later applications or hearings. Fivestar Bailiff does not provide legal advice. If you are unsure what your judgment or order allows, we recommend speaking with a lawyer before enforcement begins.

Firm, Fair and Professional

Enforcement affects people's homes, vehicles and businesses. Our personnel identify themselves, explain the purpose of the attendance and treat everyone with respect. If a situation becomes unsafe, staff withdraw, document what happened and report to the client. Where there is a risk to safety, police may be contacted.

Have a Judgment or Order to Enforce?

Send us a copy of the order and a summary of the file. We will confirm what we can do and the next steps.
